Model Selection & Forward Path of China Disaster Relief Legislation

Mother-child law model is an advisable legal model for China legal system of disaster reduction and relief. It is urgent to develop the Basic Act on Disaster Mitigation & Relief as soon as possible to guide and standardize the disaster prevention, mitigation, preparedness, relief and post-disaster reconstruction and other aspects of the legislation. On this basis, it is necessary to improve legal system of disaster prevention and mitigation rely on the Disaster Prevention and Mitigation Act, improve legal system of disaster preparedness focus on the Disaster Reserve Act; improve legal system of disaster relief rely on the Natural Disaster Relief Bill, improve legal system of disaster recovery based on the Wenchuan Earthquake Restoration and Reconstruction Ordinance, and meanwhile, promote disaster mitigation and relief organizations and personnel incentive security legislation to achieve the legalization of the disaster mitigation and relief.
